They can only do that if they make an offer and you accept it. At that stage she belongs to the ins co, not before

well fred im hoping the insurance dont crush her without letting me knw as im not going to get her crushed hoping to get her bk.and hope to get her bk to get cozy bk on the road.but depends on what i can do as never had to deal with anything like this b4 dont knw wat salvage value would b to get her bk and wat i need to do to get her bk on the road i knw i need to get it fixed but do i have to re register could it end up costing me more to fix her dont want to loose cozy but what i need to do i dont knw.just wish i could get her to do her bk up but not knowing wats going off is doing my head in.

The only time we had to deal with this was after a wiring fire. We wouldnt let the insurance take the van and kept her on the street. We got the payout (2nd offer, refuse the first) less scrap value. The V5 will be marked, prob cat D, financial write off. You dont need to re register. Thats only for stolen recovered.

if i get it bk thou and the insurance do write it of what do i need to do fred will i have to pay dvla to get it bk on road and will it effect been a cat d on insurance.as i said im new to making a claim never been in this situ b4 mate whats the cost to do all this ect i knw how much work needs to be done to fix cozy which ralph as offered to do for me but once fixed wat happens wat would i need to do.im totally lost lol.plus can i actually get it bk from where it is untill the insurance deal with wat they going to do.as insurance not been very co operative they seem to be more interested in writing her of than anything else wen i knw its not that badly damaged.

Its YOUR vehicle not theirs until you agree otherwise, they can't refuse to release it - just tell them you are fetching it back and thats that. The only time that might not apply is if there is an ongoing investigation or court case and it was likely to be needed as evidence - in which case it would be the police saying why you couldn't have it back.

police have their work don dodgerover they got prints ect of cozy the 3 people have been to court and been charged one of them was a youth they got a 6 month referral order the other two are in court on the 28th of this month and charging them with theift of a motor driving well disqualified no insurance ect ect the other the same as above but also criminal damage.so i be going to court to see what happens.so if i went to were it is they cant really refuse to let me take it bk home with me.

I don't see why not. If you are paid out, as I said the insurance won't own the van until they pay for it. Your best bet if they do is to ask the insurance if they will insure her again, and if so what do they want before they will do so (engineers report, MOT ect). We got re insured after getting a fresh MOT.

if I was you if the salvage yard is near you,or even not,i'd pay them a visit and ask them what the situation is regarding hold onto cozy.they might say you can take her if you have id as they are in theory just storing her until a decision is made but i'd make it clear to them that you don't want her crushed even put a note in the windscreen to remind them. when my bug was written off I just bought her back from the insurer pulled the dent out of the bonnet and started to use her again I don't think the insurance was an different as she was only written off due to cost of repair.

thanks guys im going to chase up insurance and tell em im going to go pick cozy up and put a stick off dinamite up their you knw wat lol if they dont get a move on with the claim all people been charged now so wat is keepig them lol.

Getting it back on the road depends on what (if any) markers they put against it, it may need a VIC (identity check costs about £70 or so) to get a new log book although as you already have the logbook in your name I can't see this is a problem Otherwise you may (or may not) need to take out a new insurance policy, just be aware some ins companies don't insure written off vehicles - Swiftcover springs to mind but when i found out it was hidden in the small print. If the MOT is still valid then you've got no need to get a new one.

IIRC Cat D doesnt need a Vehicle Identity Check. Other ins cat dont get a log book issued to a new owner, but you can still use the one you have if you dont send it to the ins co. Go get her, tell the ins you are saving them money by storing it thus avoiding storage fees

Actually do you need a VIC for commercials? I have a vague feeling you might not, anyway all it is, is someone going an looking to make sure Cozy isn't a ringer.

thanks everyone mot doesn't run out till January so hopefully i will ave her bk b4 then.but stupid insurance still not got bk to me so going to contact them today n give em a mouth full as its going on to long when they ave all they need.getting a little peed off with em to tell u the truth.
